How to Conduct an HR Investigation—at some point, nearly every human resources professional will need to conduct or oversee an HR investigation. And when the HR department needs to take action, it is critical that the investigation is done correctly to limit the risk of company lawsuits, stop any bad behavior and help ensure you're keeping good employees.

When an employee makes an informal or formal complaint, the employer needs to take steps to promptly address the alleged conflict, protect the involved parties and start an investigation. During the investigation, you need to find out what happened, determine what, if any, corrective action should be taken and whether additional preventive steps, including on a systemic level, are needed to provide your employees with the workplace they deserve—and that allow your business to flourish.

The PA Chamber presents top employment law attorney Jonathan Wetchler, Partner, Duane Morris, to walk you through the proper steps to conduct an HR investigation. He will discuss:

  • Beginning with the end goal in mind, including the critical difference between policy and legal violations, and corrective vs. preventive actions

    • when an investigation might not be necessary depending on the complaint

  • Your options about who should conduct the investigation depending on the circumstances—HR Director, attorney, third party/outside investigator
  • Approaches for conducting interviews among the concerned parties
  • What documentation should be reviewed and prepared as a part of the investigation, including document preservation obligations
  • Strategies for evaluating the evidence and determining the next steps to address the situation
  • The legal do's and don'ts when conducting HR investigations
